You represent and warrant that all information you provide is true, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for safeguarding your account credentials and for all activity occurring under your account. You may not transfer, sell, assign, or license your account to any other person.

We make every effort to present our products and services accurately. However, colors and appearance may vary based on your device and settings. We do not warrant that product appearance or quality will meet your expectations or be identical to on-screen images.

Product descriptions may change at any time without notice. We reserve the right to discontinue products and to limit quantities to any person, region, or jurisdiction at our discretion.

Section 3 — Orders

When you place an order, you make an offer to purchase. We may accept or reject any order at our sole discretion. An order is accepted when we confirm acceptance and process your payment. Please review your order carefully before submitting; cancellations may not be possible after acceptance. If we do not accept or must modify/cancel an order, we will attempt to notify you using the email, billing address, or phone number provided at checkout.

Purchases are eligible for return or exchange only as outlined in our Returns & Refunds Policy.

You represent and warrant that your purchases are for personal or household use and not for resale or commercial export.

Section 4 — Pricing & Billing

Prices, discounts, and promotions may change without notice. The price charged is the price in effect when you place the order, as stated in your order confirmation email. Unless expressly noted, listed prices exclude taxes, shipping, handling, customs, and import duties.

Prices on our online store may differ from those offered by third-party retail channels. Promotions may be subject to separate terms. If there is a conflict, the promotion terms prevail.

You agree to provide current, complete, and accurate purchase, payment, and account information, and to promptly update your account details (email, billing info, card numbers/expirations) so we can complete transactions and contact you as needed.

You represent and warrant that (i) your payment information is true and complete; (ii) you are authorized to use the payment method; (iii) your card issuer will honor charges; and (iv) you will pay all charges at posted prices, including applicable shipping, handling, and taxes.

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or events beyond our control. Title and risk of loss pass to you upon our delivery to the carrier.

The Services (including trademarks, text, samples, images, graphics, product reviews, video/audio, and their selection and arrangement) are owned by MYDOGGIE, its affiliates, or licensors, and protected by U.S. and international IP laws.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any material without our prior written consent. Except as expressly stated, nothing in these Terms grants any license to MYDOGGIE, Shopify, or third-party IP.

MYDOGGIE names, logos, product and service names, designs, and slogans are trademarks of MYDOGGIE or its licensors and may not be used without our prior written consent. Shopify marks are trademarks of Shopify. Other names and logos are the property of their respective owners.

Section 7 — Optional Tools

The Services may provide access to third-party tools we do not monitor or control. You acknowledge that such tools are provided “as is” and “as available,” without warranties. Your use is at your own risk and subject to the third party’s terms.

Section 8 — Third-Party Links

The Services may contain materials and links to third-party sites (including embedded functionality). We do not evaluate or guarantee third-party content and are not responsible for any harm arising from your use of third-party sites or purchases. Review third-party policies before transactions. MYDOGGIE uses Shopify technology to power the Services. However, all sales and purchases are made directly with MYDOGGIE. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and MYDOGGIE, including injuries, damages, or losses caused by products or services purchased. You expressly release Shopify and its affiliates from claims, damages, and liability arising from your transactions with MYDOGGIE.

Section 10 — Privacy Policy

Personal information collected through the Services is subject to our Privacy Policy and may also be subject to Shopify’s privacy policy. Because the Services are hosted on Shopify, Shopify collects and processes certain personal information to provide and improve the Services. Information you submit may be transmitted to and shared with Shopify and third parties in countries other than your own. Unless expressly stated by MYDOGGIE, the Services and all products offered through the Services are provided “as is” and “as available,” without warranties of any kind, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain warranty disclaimers; those limitations may not apply to you.

Section 16 — Limitation of Liability

To the maximum extent permitted by law, in no event shall MYDOGGIE, Shopify, or our respective affiliates, directors, officers, employees, agents, contractors, service providers, or licensors be liable for any direct, indirect, incidental, punitive, special, or consequential damages (including lost profits, revenue, savings, data, replacement costs, or similar damages), whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Services or any products, even if advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless MYDOGGIE, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, and expenses (including reasonable attorneys’ fees) arising out of (1) your breach of these Terms or referenced documents, (2) your violation of any law or third-party rights, or (3) your access to or use of the Services. We will notify you of claims subject to indemnification; failure to promptly notify will not relieve your obligations unless materially prejudicial. We may control the defense/settlement at your expense and will not settle imposing non-monetary obligations on you without consent. You will reasonably cooperate in the defense.

These Terms and any separate agreements for the Services are governed by the courts of the jurisdiction where MYDOGGIE is established. You and MYDOGGIE submit to the exclusive jurisdiction and venue of those courts.
